Mrs. Fauzia Mirza, Additional Advocate General ------------------------------------------------------------------------------------------------- Hon'ble Shri Ajay Kumar Tripathi, Chief Justice & Hon'ble Smt. Justice Vimla Singh Kapoor Order on Board Per Ajay Kumar Tripathi, Chief Justice 18.02.2019 1.
The State has filed returns way back between 20.08.2018 to 17.09.2018, indicating that the land of the petitioners have been taken over under the Right to Fair Compensation and Transparency in Land Acquisition Rehabilitation and Resettlement Act, 2013. 2.
Despite six months having elapsed since that position having been brought on record by the State, there is no challenge or rebuttal of the position.
3.
In view of the changed situation, the Court is not required to get into the academic discussion whether any change in policy brought about in relation to "Aapasi Sahmati Se Bhumi Kray Niti 2016", is otherwise required to be interfered or struck down. Since that land is not being taken by the State under the above policy now.
4.
All the writs are dismissed.
