1. The limited grievance of the petitioner has in the present writ petition is that the petitioner who was working under the respondents as Constable (G.D.) from 02.11.1991, he received certain grievous injuries on account of an accident that took place on 26.09.1999.

2. According the Counsel for the petitioner, in due course of time, because of the disability that the petitioner had suffered from the said accident, he has been medically declared invalidated w.e.f. 15.10.2007 and the invalidation pension has been started from May 2008 w.e.f. 16.10.2007.

-23. The grievance of the petitioner now is that subsequently the petitioner has not been granted any revised pension including disability pension in-terms of the CCS Extraordinary Pension Rules.

4. According to the Counsel for the petitioner, the similar benefits have already been extended to many other similarly placed persons in the department who were declared invalidated on medical ground.

5. Given the limited grievance that the petitioner has, the writ petition at this juncture is disposed of directing the respondents to immediately process the claim of the petitioner in accordance with Rules and Regulations governing the field and also taking into consideration the past precedent on the subject matter and to consider grant of disability pension and other payable dues payable to the petitioner. Let the respondents take an appropriate decision on the claim of the petitioner at the earliest preferably within a period of 90 days from the date of receipt of copy of this order.
