Hon'ble Shri Justice Sharad Kumar Gupta Oral Order 22-9 -2020

1. While dealing with the 3rd bail application of the applicant, this Court directed the trial Court to dispose of the case as soon as possible preferably within a period of 3 months from the date of receipt of copy of that order. On 18-9-2020 while hearing this case, this Court called a brief report from the Registrar Judicial as to why the report is not received from the trial Court and whether the office had issued the reminder. The trial Court has already moved an application for extension of time to conclude the trial.

2. This is 4th bail application under Section 439 of the Cr.P.C. preferred by the applicant before this Court. His no other bail application is pending before any other Court.

3. Earlier, the first bail application of the applicant was dismissed as withdrawn by this Court vide order dated 13-11-2018 passed in MCRC No. 7104/2018. His 2nd bail application was rejected by this Court vide order dated 13-2-2019 passed in MCRC No. 636/2019 considering prima facie case against him. His 3rd bail application was rejected by this Court vide order dated 9-12-2019 passed in MCRC No. 7759/2019 considering prima facie case against him.

4. Counsel for the applicant submits that he wants to withdraw this bail application. However, he further submits that the trial Court may be directed to dispose of the case as soon as possible.

5. Instant bail application is dismissed as withdrawn. However, the trial Court is directed to expedite the trial and dispose of the same as soon as possible preferably within a period of 2 months from resuming regular court work.
