1. This is first bail application filed under Section 439 of the Code of Criminal Procedure seeking grant of regular bail to the applicant in connection with Crime No. 823 of 2013 registered at P.S. City Kotwali, Mahasamund, District Mahasamund (C.G) for the offence punishable under Sections 457, 380, 34 of IPC.

2. As per the prosecution case, a report was made by Anil Kashyap that certain gold and silver ornaments were stoolen from his house. Subsequently on investigation, the other coaccused persons were arrested and on the basis of their memorandum, the applicant was arrested and the stolen goods were recovered.

3. Learned counsel for the applicant submits that the applicant has been falsely implicated in this case and since the charge sheet has been filed, no further recovery is required, therefore, the applicant may be enlarged on bail.

4. Per contra, learned State Counsel opposes the bail and

submits that as many as 20 cases of like nature have been registered against this applicant.

5. Since it is reported that 20 cases of similar nature have been registered which are pending against the applicant and if the applicant is released on bail, there would be possibility of again committing offence by the applicant, therefore, I am not inclined to allow this bail application. Accordingly it is rejected.
