1. It is projected in the writ petition that the petitioner is working as daily wager (Chowkidar) in the office of RES, Division Surajpur, District Surajpur, C.G. Pursuant to the State Government's circular dated 05.03.2008, his case was considered by the scrutiny committee for recommending for regularization and a positive recommendation was made, however, the competent

authority has not yet passed any order on the recommendation.

2. Considering the entire facts situation of the case, the writ petition is disposed of with direction that the authority competent to consider petitioner's case for regularization shall pass necessary orders in terms of the circular dated 05.03.2008 at the earliest, preferably within a period of 4 months from the date of presentation of certified copy of this order.

3. It is made clear that this Court has not expressed any opinion on the merits of the case and the respondent authorities shall decide the matter, on its own merits, strictly in accordance with law, without treating any observation made in this order, as opinion on the merits of the case Sd/- Judge Prashant Kumar Mishra Ashu
