Learned counsel for the petitioner would submit that though his civil suit has been dismissed on the ground of lack of jurisdiction but he may be allowed to make an application under Section 16(3) of the Indian Telegraph Act, 1885 (for brevity, ' Act of 1885') before the District Judge for appropriate relief.

I have heard learned counsel for the petitioner. 3.

The prayer is fair and reasonable.

Be that as it may, the petitioner would be at liberty to proceed in accordance with law by making an application under Section 16(3) of the Act of 1885 before the appropriate authority that will be considered and decided by the said authority expeditiously.

With the aforesaid observation, the writ petition stands finally disposed of. No order as to cost(s).
