Learned counsel for the petitioner would submit that application for grant of lease on the suit land is pending consideration before competent authority. This Court vide order dated 23.7.2010 passed in WP (C) No.3738 of 2010 has also directed for consideration to the State Government, but though the impugned order has been passed directing his dispossession, however, no final decision has been taken on his application by the Collector, Raipur.

Be that as it may, respondent No.2/Collector, Raipur is directed to consider the petitioner's case for lease within a period of two months from the date of receipt of copy of this order on its own merit. It is further

directed that after the order of Collector on the petitioner's application for lease, the Tahsildar (Nazul), Raipur would proceed depending upon the result of the order passed by the Collector. It is made clear that this Court has not expressed any opinion on merits of the matter and not directed for grant of lease to the petitioner. It will be considered on its own merit.

With the aforesaid observation, the writ petition stands disposed of. No order as to cost(s).
