This is the first bail application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicant who has been arrested in connection with Crime No.355/2015 (wrongly mentioned in the impugned order as Crime No.356/2015) registered at Police Station- Urga, District Korba (C.G.) for the offence punishable under Section 420, 467, 468, 471, 120-B, 201, 34 of Indian Penal Code.

Case of the prosecution, in brief, is that the applicant along with other co-accused have allured different persons to provide job and collected the amount. On investigation being made, on the basis of memorandum of the other co-accused, the applicant was arrested. 3.

Learned counsel for the applicant would submit that only on the basis of memorandum of other co-accused, this applicant has been arrested and no evidence is available against this applicant, therefore, he may be released on bail.

Per contra, learned State counsel opposes the prayer for grant of bail.

Perused the case diary and the documents. It reveals that on the basis of memorandum, the forged documents about the appointment were also seized alongwith Register to show payments. Considering the evidence available on record and the way the offence has been committed, I am not inclined to release the applicant on bail.

Accordingly, the bail application filed under Section 439 of the Cr.P.C. is rejected.
