Mr. Vaibhav Shukla, counsel for respondent No.1. The prayer made in this writ petition is to restrain Respondent No.1/SECL from invoking the Bank Guarantee. Counsel for respondent No.1 on instructions would submit that at this moment, they have not issued any letter to the Bank/respondent No.2 for invoking the bank guarantee. He submits that the petition is premature and is liable to be dismissed.

In view of the statement made at bar by counsel for respondent no.1 that at this stage they have not issued any letter to the Bank for invoking bank guarantee , this writ petition is premature.

The petitioner shall be at liberty to avail appropriate remedy as and when occasion arises in future. With the above observation, this writ petition stands disposed of.
