Heard.
The petition has been brought for making a prayer for grant of permission to go abroad. It is submitted that the only daughter of the petitioner is residing in U.K. and she is suffering from illness because of which the petitioner wants to visit and take care of her daughter for some time. There is no restriction in the order passed by this Court granting anticipatory bail to the petitioner, even then in a bona-fide manner, the petitioner wants to inform this Court and seeks a formal permission of this Court.
Learned State counsel opposes the application, however, he submits that there is no such condition placed in the order granting anticipatory bail by this Court.
I have heard the learned counsel for the parties and perused impugned judgment.
The application is supported with an affidavit given by the
petitioner herself. Further, the investigation has not been completed so far and it has not been appeared that there is any requirement of the petitioner in the investigation to be made at present. After due consideration, I feel inclined to allow this application. The petitioner is permitted to go abroad for two months after submission of itinerary before the Court below regarding the date of her travel and the place she has to visit. And on the day she comes back, she will require to give report to the Court concerned about her arrival back to the country.
Accordingly, the petition is disposed off.
