Learned counsel for the petitioner would submit that though at the instance of the respondent No.4, a complaint was made that few of the villagers have encroached upon the government land and accordingly they were removed, but the respondent No.4 himself is occupying the government land. He further submits that the finding was arrived at by Annexure P-4 that the petitioner is occupying the government land bearing 449, therefore, the respondent No.4 shall have the same consideration and he should be removed.

Perused the documents. At this stage, the Court has not expressed any opinion on Annexure P-4. It is for the revenue department to enquire as to whether the respondent No.4 has encroached upon the government land or not. Therefore, the respondent authorities are directed to make enquiry as to whether the respondent No.4 is occupying the government land or not and shall pass an order accordingly within a period of three months from the date of presentation of a copy of this order. 3.
