Petitioner, in the present Writ Petition, is aggrieved of the action on the part of Respondent in not promoting him from the post of Assistant Engineer to the post of Executive Engineer.

Learned Counsel for Petitioner submits that on the previous occasion when the DPC was convened, the Petitioner was considered for promotion and from the available record it appears that the Petitioner has also scored more marks than the other persons who were in the zone of consideration, in spite of that the Petitioner has not been promoted and juniors to him have been promoted. 3.

Learned Counsel for Petitioner further submits that the Petitioner is not subjected to any departmental enquiry nor is he facing any criminal case by which he could have been denied or deprived of promotion. Neither does the Petitioner know as to whether the recommendations of the DPC so far as the Petitioner is concerned either deferred or kept in sealed cover. 4.

Given the aforesaid factual matrix of the case as narrated by learned Counsel for Petitioner, this Court is of the opinion that for the said grievance since the representation of Petitioner is pending consideration before the Respondent, the present Writ Petition at this juncture is disposed of directing the Respondent to take an appropriate decision on the representation of Petitioner so far as his

claim for promotion from the post of Assistant Engineer to the post of Executive Engineer is concerned.

In addition, the Petitioner would also be at liberty to file a fresh representation supported with all relevant documents. 6.

Respondent is excepted to take a decision in this regard on due consideration of the same, in accordance with law, at the earliest, preferably within a period of 60 days from the date of receipt of copy of this Order. 7.
