Hon'ble Shri Justice P. Sam Koshy Order on Board 05/08/2020

1. The challenge in the present is to the order Annexure P/1 dated 25.06.2020 passed by the respondent No. 3 Committee.

2. The order has been questioned primarily on two grounds, firstly, the order has been passed without affording any opportunity of hearing to the petitioner, secondly, the respondent No. 3 committee does not have the power and jurisdiction to entertain such an application moved by the respondent No. 4.

3. This Court is of the opinion that instead of filing a writ petition questioning the same, it would be more appropriate for the petitioner to approach the respondent No. 3 Committee itself by moving an appropriate application seeking reconsideration of the order dated

25.06.2020. Upon an application being moved by the petitioner for reconsideration of the same, it is expected that the respondent No. 3Committee shall consider the same and pass a suitable order at the earliest.

4. With the aforesaid directions, the writ petition stands disposed of. Sd/- (P. Sam Koshy) Judge Jyotijha
