Proceedings through Video Conferencing Hon'ble Shri Justice Prashant Kumar Mishra Order On Board 02/09/2020

1. This is the forth bail application preferred by the applicant under Section 439 of CrPC for grant of bail, as he is arrested in connection with Crime No.265/2017, registered at Police Station Mahasamund, District Mahasamund, for the offence punishable under Section 302 of IPC.

2. The first bail application was dismissed on 29.11.2017 in

MCRC No. 5023 of 2020 MCRC No.6477/2017 by a detailed order reserving liberty to move again after examination of witnesses Ashalata, Vijaya Das and Padma Das. The second bail application was dismissed on 10.09.2018 in MCRC No.6281/2018 on merits. The third bail application was also rejected on 21.11.2019 in MCRC No.7047 of 2019 with direction to the trial Court to decide the trial expeditiously.

3. According to the applicant, the material witnesses have been examined by the trial Court but they have not supported the prosecution case. He would submit that due to out break of COVID-19 pandemic situation, the trial has stopped from 08.04.2020 and there is no progress till date.

4. Having considered the fact situation of the case and considering the seriousness of the crime, it appears that there is no change in the circumstances and hence I am not inclined to grant bail to the applicant.
