The applicant has preferred this second bail application under Section 439 of CrPC, as he is arrested in connection with Crime No.75/2020 registered at Police Station Narayanpur, District Narayanpur (CG), for the offence punishable under Sections 302 & 201 of the Indian Penal Code.

The first bail application bearing MCrC No.8485 of 2020 was dismissed by order dated 18-2-2021 for want of prosecution.

Applicant, Pankaj (since deceased) and witness Sajal Biswas were sleeping together in a room. At about 2'O clock in the midnight Sajal Biswas awoke to attend the nature's call and found that the deceased is not available on his bed. On enquiry from the applicant he confessed that he has committed murder of the deceased. 4.
Considering the entire facts situation of the case, I am of the opinion that present is not a fit case to release the applicant on regular bail at this stage.

Accordingly, the bail application is rejected with liberty to revive the prayer after examination of witness Sajal Biswas.
