1. Learned counsel for the petitioner would submit that on 16.07.2019 the respondent No. 5 has canceled the contract given to the petitioner in respect of the supply of ready to eat food under Mid-Day Meal scheme. It is stated that subsequently the petitioner has filed an appeal/ representation before the Collector by Annexure P-5 dated 10.11.2020 which is still pending which may be directed to be decided.

2. Given the said facts and circumstances of the case, considering the fact that the decision of Block Education Officer is under challenge before the Collector

and the petitioner having already been approached the Collector by filing an appeal/ representation, the writ petition itself can be disposed of at this juncture by directing Respondent No. 2 to decide the representation of the petitioner within a reasonable time. However, the petitioner would be at liberty to file a fresh representation if so chooses. The petitioner may also file interim application if so advised. It may be decided according to its own merits. It is made clear that this Court has not expressed any opinion to the right of the petitioner. The Collector shall decide the representation of the petitioner Annexure P-6 or any other fresh representation if filed within a further period of 60 days from the date of receipt of the copy of this order. 3.
