1. The matter is heard through Video Conferencing.

2. The applicant has preferred this first bail application under Section 439 of Cr.P.C. as he has been arrested in connection with Crime No.228/2021 registered at Police Station- Bhilai Nagar, District Durg, C.G. for the offence punishable under Sections 376(2)(n) of Indian Penal Code and Section 3(2)(v) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act.

3. Learned counsel for the applicant submits that he does not want to prosecute this bail application and seeks to withdraw the same with liberty to file duly constituted appeal under the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act.

However, he prays for return of certified copy of the impugned order.

4. Permission granted.

5. Accordingly, the bail application stands dismissed as withdrawn with the aforesaid liberty.

6. Registry is directed to return the certified copy of the impugned order to the counsel for the applicant on his furnishing true authenticated Xerox of the same.
