This is third application for grant of bail mainly on the ground of delay in trial on the submission that the witnesses are not turning up and the applicant has been languishing in jail for the last two years since 24-04-2016. 3.

Considering that the applicant is in jail since long, the trial Court is directed to conclude the trial as early as possible without granting unnecessary adjournment to any of the parties. The trial Court shall do well to take coercive steps against those prosecution witnesses, who have failed to appear to depose before the Court, despite issuance of summons followed by bailable warrants. In case, after summons, witnesses are not appearing, bailable warrant may be issued immediately. The progress of the trial shall be reported to the Registry of this Court within a period of three months.
