Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 11/08/2016 The transfer order is under challenge on the ground that the petitioner has been transferred to accommodate respondents 4 and 5 who continued on attachment in the present office since long even though they were earlier posted in the school at Ranai.

It is also submitted that the petitioner has personal problems like ailment of her father and the petitioner being the only person to take care of her father. It is not in dispute that the petitioner has remained posted since 06/05/2013. That means, for more than three years, the petitioner remained at present place. The transfer place is hardly 35 kms. away from the present place of posting. Therefore, there is no ground to interfere with the transfer order on

judicial side under Article 226 of the Constitution of India. As representation in this regard has already been made, the same shall be decided within three weeks from the date of receipt of copy of this order, if not already decided.
