S.B.:

Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 11/08/2016 Heard on admission.

1. Transfer order is under challenge on the ground that at present, the petitioner's wife is being treated at an infertility centre Durg, therefore, it is necessary that the petitioner may be allowed to continue at Durg only.

2. By the impugned order, the petitioner has been transferred from Durg to Balodabazar, which is not far away from Durg. The wife of the petitioner is posted at Mahasamund and not at Durg. Therefore, the impugned order does not adversely affect the petitioner. As and when petitioner's wife is required for treatment at Durg she can be brought by the petitioner considering that the distance of Durg from Balodabazar is hardly 100-125 k.m. There is no ground to interfere with the transfer order by this Court. However, it will always be open for the petitioner to prefer representation

-2to the competent authority for seeking appropriate adjustment.

3. With the aforesaid observation, the petition is dismissed. Sd/- (Manindra Mohan Shrivastava) Judge Praveen
