Hon'ble Shri Justice Goutam Bhaduri Order On Board Proceedings Through Video Conferencing 31.07 . 2020 Heard 1.

The present petition is against the order order of transfer dated 13.07.2020, whereby the petitioner services have been transferred from Gram Panchayat, Ragja to Gram Panchayat Rishabhtirtha.

It is contended that the Anneure P-1 would show that the transfer has been made pursuant to the the proposal dated 30.06.2020, whereas the proposal of 30.06.2020 do not speak about transfer of the petitioner to Rishabhtirtha, instead recommended the transfer to Nandeli vide Annexure P-3, therefore, the transfer has been made to accommodate respondent No.4 only. 3.

Per contra, learned State counsel opposes the arguments and would submit that the distance of transferred place is only 35 Kms. 4.

Perused the documents. Perusal of the documents prima facie shows that the petitioner was working at Ragja since 2014 as a Panchayat Secretary. Though the proposal dated 30.06.2020 shows that the proposal was made to transfer the petitioner to Nandeli, however, she has been transferred to Rishabhtirtha. Considering the fact that the transfer is within the same Janpad Panchayat i.e. Sakti, I am not inclined to interfere with the transfer order and stay the same, specially taking into the fact that the distance of transferred place is stated to be 35 Kms. However, considering the prayer made, it is directed that the petitioner may file the representation before the respondent No.3 i.e. the CEO, Janpad Pancayat, Sakri to reconsider her transfer to other place. If such representation is made, the same may be decided according to the existing facts and situation.
