1. In view of the fact that the decree of divorce has been allowed on the application filed by the respondent/husband during the pendency of the present appeal.
2. Learned counsel for the parties would jointly submit that the present appeal which has assailed the decree for restitution of conjugal right has been rendered infructuous.
3. In view of the statement made, the appeal is dismissed as infructuous.
