1. The grievance of the petitioner is that the petitioner has completed more than 30 years of service on 01.01.2016 and according to the circular of the State government dated 08.08.2018 on completion of 30 years of service the employee would be entitled for third time pay scale benefits.

2. Learned counsel for the petitioner would submit that though the petitioner was granted first and second time pay scale benefits but he was actually entitled for third time pay scale benefit on completion of 30 years of service on 01.01.2016. Thereafter, when the petitioner approached the department for benefit of third time pay scale, he was found eligible according to the

circular of the State and the same was calculated by Annexure P-2, however the amount has not been released till date.

It is further submitted that the petitioner already stand retired on 31.10.2018 and under the circumstances to get the arrears the petitioner has made a representation (Annexure P-4) to Respondent No. 4 . He further prays that the respondent No. 4 may be directed to decide the same within a stipulated period and release the amount accordingly.

4. Considering the limited prayer made and the claim of the petitioner that he is entitled for third time pay scale benefit on completion of 30 years and as the petitioner has already made a representation to Respondent No. 4. The Respondent No. 4 is directed to decide the representation (Anneuxre P-4) of the petitioner within a further period of 90 days from the date of receipt of a copy of this order.
