This MCC has been filed by the petitioner seeking modification of earlier order and for issuance of direction to consider the case of the petitioner for cancellation / modification of the transfer order not only on the ground of ailment, but also on the ground that wife of the petitioner has been posted at Dhamtari and that he had not given any consent.

These two grounds were not pressed into service at the time of argument, therefore, I am not inclined to make any modification in the earlier order.

However, if these grounds are available, the petitioner may make representation for consideration by the competent authority and order passed by this Court may not be construed to limit consideration only on the ground of ailment.

The MCC is accordingly disposed off.
