For State :

Mr. Dhiraj Wankhede, GA ----------------------------------------------------------------------------------------------- Hon'ble Shri Justice Manindra Mohan Shrivastava Order on Board 18/05/2018 1.

The transfer order dated 27-03-2018 is under challenge on the ground that the petitioner is being transferred under the impugned order on the ground that the petitioner and respondent No. 5 had given an option for mutual transfer.

2.

The submission of the learned counsel for the petitioner is that the option was given about one and half years before and the reason for that mutual transfer came to an end, therefore, it could not be pressed into service after such a long time.

3.

It is not known as to what is the period within which the requests have to be kept alive but the fact remains that the petitioner had given option long back. If the petitioner makes a representation within a period of 15 days from today, the State authority may consider the petitioner's representation. The decision will have to be taken within a period of four weeks. The petitioner shall not be relieved if not relieved, till the decision is taken. Accordingly, the petition is disposed off.
