The sole ground of challenge to the transfer order is that the petitioner has been transferred from scheduled area to nonscheduled area, without there being any reliever, he could not be relieved from the present place of posting as per provisions contained in Clause (1) (vii) of the Transfer Policy dated 11.06.2016.

The aforesaid ground is not available to the petitioner. Whether the reliever of the petitioner has joined or not is of administrative look out and it does not prejudicially affect the petitioner. 3.
In the case of Ms. Manisha Agrawal Vs. State of Chhattisgarh and Others, 2015(4) C.G.L.J. 182, wherein relying upon several judgment of the Supreme Court, it has been held by this Court that once the employee has been transferred, it is required to be complied with unless it is modified, varied or cancelled. Therefore, the petition is dismissed.
