The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No. 151/2015 registered in Police Station Out Post Bariyon, P.S. Rajpur, Dist. Balrampur for offence punishable under section 306 of Indian Penal Code. 2.

As per the prosecution case the applicant was in love affair with the deceased Jeevanti and was persuading her to perform marriage and therefore for such reason the deceased jumped into the well on 4/10/2015 and committed suicide.

Learned counsel for the applicant submits that applicant was in love affair with the deceased and she fell down into the well and died. Subsequently, the report is made as the applicant was in love relation with the deceased to inculpate him falsely in the case. Therefore, learned counsel submits that the applicant may be released on bail. 4.

Learned State counsel opposes the prayer for grant of bail. 5.

I have perused the case diary and the statement. Considering the

facts and circumstances of the case, statement of the witnesses, charge sheet in this case has been filed and considering the pre-trial detention that the applicant is in jail since 12/10/2015, this court is inclined to release the applicant on bail.

Accordingly, the bail application is allowed and it is directed that the applicant shall be released on his furnishing personal bond for a sum of Rs.25,000/- with one surety in the like sum to the satisfaction of concerned trial court for his regular appearance before it as and when directed.
