Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 26/07/2017 Though return has not been filed, learned counsel for the petitioner, at the outset, submits that except the relief for payment of interest of gratuity, all other prayer have rendered infructuous as all other payments have been made to the petitioner.

According to learned counsel for the petitioner, the issue with regard to payment of interest on gratuity has been decided by the Division Bench of this Court in the case of Karnail Singh v. The General Manager, Bishrampur area of SECL and ors. in W.A.No.56/2017 decided on 17/03/2017. 3.

Learned counsel for the respondents would submit that though there is no quarrel with the legal issue settled by this Court for grant of gratuity amount, verification of the facts of the case would be necessary. 4.

Considering the submission, this petition now can be disposed off with a direction to the respondents to consider petitioner's claim for grant of interest on

gratuity in the light of the decision of this Court in the case of Karnail Singh (supra) and take decision and pay interest to the petitioner within a period of 60 days from the date of receipt of copy of this order. If the amount is not paid in the time stipulated, it will carry interest on the amount which is due and payable. The petitioner would be at liberty to revive this petition if grievance is not redressed / fully redressed. Sd/- (Manindra Mohan Shrivastava) Judge Deepti
