1. This is an application for condonation of delay in filing the CRMP, an application for grant of leave to appeal.

2. Having considered the explanation offered in support of the prayer for condonation of delay of 141 days, this Court is satisfied that the delay in filing the CRMP deserves to be condoned.

3. Accordingly, IA No.01 is allowed and the delay of 141 days in filing the application for leave to appeal, is condoned.

4. This is an application filed by the State for grant of leave to appeal.

5. Having considered the evidence particularly the statements of the prosecutrix and her mother, the application seeking leave to appeal deserves to be and is hereby allowed.

6. Let the regular Acquittal Appeal be registered and notice of the same be issued to the respondent on payment of P.F. as per rules. If the respondent fails to appear before this Court on the next date of hearing or notice is not served on him for any reason, this Court may take coercive steps to secure his appearance.

7. List the matter after 10 weeks.

8. The CRMP stands disposed of.
