Raigarh (C.G.) ---- Respondents For Petitioner:

Shri Keshav Dewangan, Advocate.

For Respondents/State:

Shri Shashank Thakur, Govt. Advocate.

Single Bench:

Hon'ble Shri P. Sam Koshy, J Order On Board 18/03/2015 The petitioner through the instant writ petition is challenging the order Annexure P-5 dated 27.1.2015 whereby the services of the petitioner as an Accountant have been terminated. 2.

A perusal of the record would show that the petitioner was appointed earlier on contractual basis for a period of one year and the condition to the appointment stipulated that in case the State authorities intend to discontinue the services, they shall issue appropriate orders after providing one months' time. In the instant case, it is reflected that prior to the passing of the impugned order, the said requirement of removal by providing one month's notice has been complied with and the petitioner had been provided a notice of termination from the services and as such this Court does not find any illegality in the impugned order. 3.

However, at this juncture, counsel for the petitioner submits that he

may be permitted to withdraw the instant writ petition with liberty to approach the concerned Collector for redressal of his grievance and also for requesting to grant reappointment by filing representation against the issuance of the impugned order dated 27.1.2015. 4.

Accordingly, the instant Writ Petition is dismissed as withdrawn with the liberty as prayed for.
