The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No.106/2015 registered in Police Station Balko Nagar, District Korba (C.G.) for offence punishable under section 409 of Indian Penal Code.

As per the prosecution case, the applicant while working as Principal in District Institute of Education and Training Center, Korba in between period 2011 and 2013 made different defalcation and amount of Rs.4,77,615/- was mis-appropriated which came to light after audit was made. Thereby, offence has been committed.

Learned counsel for the applicant submits that the report was made after two years and entire documents have been collected, applicant has been falsely implicated and the amount so stated that was of purchase committee for which different body was existing and the applicant cannot be held liable, therefore the applicant may be released on bail. 4.

Learned State counsel opposes the prayer for grant of bail.

Perused the case diary and the documents. Considering the facts and circumstances of the case, all the evidence are documentary in nature, this court is inclined to release the applicant on bail. 6.

Accordingly, the bail application is allowed and it is directed that the applicant shall be released on his furnishing personal bond for a sum of Rs.25,000/- with one surety in the like sum to the satisfaction of concerned trial court for his regular appearance before it as and when directed.
