Shri Shashank Thakur, GA for the State Hon'ble Shri Justice Prashant Kumar Mishra Order On Board 15/05/2017

1. Petitioner has been appointed to work as accountant on contract basis on 25.08.2007 and was posted at Kasturba Gandhi Balika Awasiya School, Bodla. On 04.11.2015, he was transferred to work in the office of Block Resource Co-ordinator, Rajeev Gandhi Shiksha Mission, Bodla. While the

petitioner was working at Bodla, the impugned order has been passed, whereby the surplus accountant/Mobile Resource-cum-accountant (contract) Shri Benjamin Minj, the respondent No.6 has been posted at the petitioner's place without there being any order affecting the petitioner.

2. It appears, the effect of impugned order is of posting two persons, working in the same office in the same capacity, therefore, to resolve the anomaly and to avoid payment of salary to two persons while obtaining work from only one of them, ends of justice would be served if the writ petition is disposed of with direction that the petitioner shall submit representation before the Mission Director, Rajeev Gandhi Shiksha Mission, Chhattisgarh, Raipur, within a period of 15 days from today, upon which the said authority shall decide the issue in consultation with the Collector-Cum-District Mission Director, Rajeev Gandhi Shiksha Mission, Kabirdham, within a further period of six weeks.

3. Till the representation is decided by a speaking order, the petitioner shall be allowed to continue in the office of Block Resource Co-ordinator, Rajeev Gandhi Shiksha Mission, Bodla.
