For respondent : Shri Arvind Shukla, Panel Lawyer Hon'ble Shri Justice Chandra Bhushan Bajpai Order On Board 16/06/2015 Bailable warrant issued against the appellant for his appearance before this Court returned unserved along with communication sent from Station House Officer, Police Station Sarkanda that the appellant died on 08.6.2014 at Padav Chouk, Near Balaji Hotel, Police Station Kotwali, Mungeli. The communication is followed by copy of merg intimation and other documents.

As the appellant died on 08.6.14 and no any near relative within the prescribed time limitation applied before the Court for leave to continue the appeal, the appeal filed on behalf of the appellant stands abated under the provisions of Section 394(1) of the Code of Criminal Procedure.

The appeal dismissed as abated.
