Hon'ble Shri Justice Sanjay K. Agrawal Order On Board /0 9 /201 (1) Learned counsel appearing for the petitioner would submit that the petitioner's / defendant opportunity to lead evidence has been closed as the counsel concerned was ill on the date of evidence and the suit is for the recovery of money along with interest.

(2) I have heard learned counsel appearing for the petitioner and perused the order impugned with utmost circumspection.

(3) Be that as it may, interest of justice will be served if the petitioner is granted opportunity to lead evidence and, therefore, the defendant is directed to keep all his witnesses present before the trial Court on 9th October, 2017 for their examination and on that day, the defendants will be examined and thereafter the trial Court would proceed further in accordance with law subject ot payment of cost of 2,000/- payable to the plaintiff.
