Learned counsel appearing for the petitioner would submit that respondent No. 4 has encroached upon the government land, which is adjacent to the petitioner's land and Tahsildar by order dated 09.02.2016 directed the Halka Patwari to inspect the encroachment made by respondent No. 4. He relied upon the judgment of the Supreme Court in the matter of Jagpal Singh & others Vs. State of Punjab and others 1 in support of his case for removal on the encroachment upon the government land. 2.

Be that as it may, Tahsildar is already seized of the matter. Petitioner is at liberty to AIR 2011 SC 1123

appear and take necessary steps in that regard. The petitioner is also at liberty to bring notice of the Tahsildar about the judgment of the Supreme Court in the matter of Jagpal Singh (supra), who will proceed further in accordance with law after hearing the affected parties.
