Badri Prasad Shrivas v. State Of Chhattisgarh
HIGH COURT OF CHHATTISGARH, BILASPUR Order Sheet WPS No.3628 of 2021 Badri Prasad Shrivas Vs. State of Chhattisgarh & Others 15.07.2021 Shri Ishan Verma, Advocate for the petitioner. Shri Amrito Das, Addl. Advocate General along with Shri Ayaz Naved, Govt. Advocate for the State.
The present writ petition has been preferred against the order dated 18.01.2021 whereby invoking rule 10 of Chhattisgarh Civil Services (Classification Control and Appeal) Rules, 1966 (in short, the CCA Rules) the petitioner has been inflicted with minor punishment of withholding of promotion. Perusal of record would reveal that the said order is an appealable order under Rule 23 of the CCA Rules. It appears that the petitioner has not preferred any appeal and has straightway filed the present writ petition after about 6-7 months of time from the date of issuance of impugned order. Given the fact that there is a channel of appeal available under the statutory rules governing the filed, let the petitioner prefer an appeal before the appellate authority within a period of 15 days from today and upon preferring an appeal the appellate authority is expected to take a decision on the appeal within a period of 60 days from the date of receipt of appeal so filed by the petitioner. The writ petition accordingly stands disposed of with the aforesaid liberty and direction to the respondents.
