Agrawal Order On Board 17/05/2017 (1) Learned counsel appearing for the petitioner/defendant submits that while allowing the application under Section 65 of the Indian Evidence Act filed by the respondent/plaintiff wherein Section 66 of the Indian Evidence Act has not been followed and no such plea has been recorded by the trial Court and therefore, he may be granted liberty to file an appropriate application before the trial Court.

(2) Prayer appears to be fair and reasonable.

(3) The petitioner is granted liberty to file an appropriate application before the trial Court. If such the application is filed by the petitioner within a period of two weeks from today, the trial Court shall consider and decide the same strictly in accordance

with law, expeditiously.

(4) With the aforesaid observation, the writ petition stands finally disposed of. No order as to cost(s).
