The applicant has preferred this bail application under Section 439 of the CrPC, as he has been arrested in connection with Crime No.295/2019, registered at Police Station Gandhinagar, District Surguja (C.G.) for the offence punishable under Sections 363, 366 & 376 (Ka) (Kha) of IPC and Sections 5 (Da) read with Section 6 and Section 9 (Da) read with Section 10 of the POCSO Act.

The applicant has sexually assaulted the girl, aged about 10 years.

Considering the material available in the case diary, this Court is not inclined to release the applicant on bail. 4.
