Hon'ble Shri Justice Sanjay K. Agrawal Order On Board 19/06/2017 (1) Learned counsel appearing for the petitioner would submit that the first appeal of the petitioner has been dismissed as barred by limitation and therefore, he may be permitted to file second appeal under Section 100 of Code of Civil Procedure. (2) Prayer appears to be fair and reasonable.

(3) Accordingly, the petition is dismissed. However, the petitioner is at liberty to file second appeal under Section 100 of Code of Civil Procedure.

(4) The certified copy of the order impugned be returned to the learned counsel for the petitioner, after furnishing an attested photocopy thereof.
