(2) Learned counsel appearing for the petitioner submits that the petitioner has been transferred from the Primary School Tikrapara (Halba), Block Charama, District Kanker to Primary School Nironda, Block Koyalibeda, District Kanker declaring her as surplus teacher by

the impugned order dated 31.10.2015 passed by respondent No.2Chief Executive Officer, Jila Panchayat, Kanker and therefore, she may be permitted to make a representation before respondent No.3Collector, South Bastar Kanker, to which counsel for the State has no objection.

(4) Prayer appears to be fair and reasonable.

(5) The petitioner is permitted to make a representation before respondent No.3-Collector, South Bastar Kanker within 15 days from today. If such representation is made by the petitioner before the respondent No.3, the respondent No.3 shall consider and decide the same on its own merit and in accordance with law preferably within a period of 45 days from the date of receipt of representation of the petitioner.

(6) However, if the petitioner is already not relieved till this date, she shall not be relieved by the said authority for a further period of sixty days.

(7) With the aforesaid observation, the petition stands finally disposed of. No order as to cost(s).
