1. The challenge in the present writ petition was to the proceedings drawn by respondent no.2, the Authority under Chhattisgarh Shops and Establishments Act, 1958.

2. The dispute pending before the respondent no.2 was the alleged termination order issued by the petitioner establishment to the respondent no.1. Present writ petition was filed on 03.01.2008.

3. Perusal of the order sheets of this Court would show that there was no interim protection granted against the proceedings so initiated by

respondent no.2 on the appeal preferred by respondent no.1. By efflux of time and passage of 11 years, this Court is of the opinion that the proceedings before respondent no.2 must have definitely been concluded by now and as such the present writ petition in its present form would get rendered infructuous.

4. Reserving the right of the parties to challenge the subsequent development and order, if pass, the writ petition stands dismissed as having become infructuous Sd/- P. Sam Koshy Judge Khatai
