Shri Arvind Sinha, Advocate Hon'ble Shri Deepak Gupta, Chief Justice Order on Board 29.7.2016 1.
On 15.7.2016, no one had appeared for the Respondent. The matter was adjourned for today specifically mentioning that in case, no one appears on behalf of the Respondent on the next date, the matter shall be decided in absence of the Respondent. Today, no one appears for the Respondent. I proceed to decide the matter. 2.
This is a petition filed by the wife for transfer of a divorce petition, being Civil Suit No.544-A of 2014 filed by the husband before the Family Court, Bilaspur to the Family Court, Baloda Bazar. 3.
The main grounds urged for transfer of the civil suit is that the wife has two minor children, she lives along with them at Baloda Bazar and she has no earning and the husband has filed the divorce petition at Bilaspur and, therefore, it is difficult for her to appear before the Court at Bilaspur.
4.
No one appears for the Respondent to oppose the instant transfer petition. Having considered the grounds urged for transfer of the divorce petition, the transfer petition deserves to be allowed.
5.
In the result, the transfer petition is allowed. Civil Suit No.544-A of 2014 is transferred from the Family Court, Bilaspur to the Family Court, Baloda Bazar.
