1. The applicant has preferred this application under Section 439 of Cr.P.C. as he is in jail since 13.07.2019 in connection with Crime No. 323/2019 registered in Police Station- Khurshipar, District Durg (CG) for the offence punishable under Sections 302 & 201 of IPC.
2. Looking to the statements of the witnesses, only 06 witnesses have been examined out of 27 witnesses, therefore, I am not inclined to grant bail to the applicant.
3. After arguing some time, learned counsel for the applicant seeks to withdraw this application with liberty to file a fresh application as and when occasion arises.
4. Accordingly, the application is disposed of as withdrawn with the liberty as stated above.
