1. The dispute in the instant case is confined to the claim of the petitioner for grant of seniority from a back date i.e. from 03.04.2007 in stead of 02.05.2017 as has been granted by the Department.

2. Counsel for the petitioner, referring to a correspondence made by respondent no.5 to respondent no.3, submits that the representation of the petitioner has been forwarded by respondent no.5 for consideration and a decision is pending consideration at the level of respondent no.3.

3. Given the fact that the dispute for grant of seniority from a back date i.e. from 03.04.2007 is pending consideration before the State Govt., this Court is of the opinion that ends of justice would meet if respondent no.3 is directed to ensure that the representation of the petitioner which has been forwarded by respondent no.5 is considered and decided on its merit in accordance with the rules and regulations governing the service conditions of the petitioner. It is expected that respondent no.3 shall take a decision within a period of 4 months from the date of receipt of copy of this order.

4. The writ petition accordingly stands disposed of. Sd/- P. Sam Koshy Judge Khatai
