Hon'ble Shri Justice P. Sam Koshy Order on Board 13.07.2021 .

1. The limited grievance that the petitioner seeks at this juncture is for an appropriate direction to the respondent No. 2 to take an appropriate decision on the representation of the petitioner for transferring the petitioner to a place nearby Durg where his spouse is already working in the District Court establishment.

2. The contention of the petitioner is that he has already served in a scheduled area for last eight years and therefore his case may be considered sympathetically by the respondent No. 2 keeping in view the transfer policy of the State Government.

-23. Without expressing any opinion on the merit of the case, considering the nature of relief that the petitioner seeks and which is purely within the domain of the respondent No. 2 to take a decision, the present writ petition is disposed of directing the respondent No. 2 to take an appropriate decision in accordance with law on its own merits at the earliest preferably within a period of four months from the date of receipt of copy of this order.

4. The writ petition accordingly stands disposed of. Sd/- (P. Sam Koshy) Judge Jyotijha
