Hon'ble Shri Justice Gautam Chourdiya Order on Board 31/08/2021 1) The matter is heard through Video Conferencing. 2) The applicant has preferred this application under Section 439 of Code of Criminal Procedure, 1973 as he is in custody since 15/06/2021 in connection with Crime No. 443/2020 registered at Police Station Kusmunda, District Korba (C.G.) for the offence punishable under Sections 457 & 380 of Indian Penal Code. 3) At the outset, learned Counsel for the State submits that there are as many as 02 criminal antecedents against the present applicant. 4) In view of above, learned Counsel for the applicant does not want to press this application and seeks to withdraw the same with liberty to repeat his prayer for bail, if the trial is not concluded within a period of three months.

5) Accordingly, the application is dismissed as withdrawn with aforesaid liberty. The Trial Court is directed to expedite the trial and conclude the same as early as possible.
