The petitioner has preferred this writ petition against the order by which the petitioner's application for grant of parole has been rejected.

Learned counsel for the State submits that in view of the return filed, the District Magistrate, Gariyaband will consider the case of the petitioner for grant of parole afresh within ten days. 4.

Heard learned counsel for the parties.

In view of the statement of the learned counsel for the State, the matter is remitted back to District Magistrate, Gariyaband for consideration of the application of the petitioner for grant of parole to him, within ten days from the date of receipt of a copy of this order. 6.
