Hon'ble Shri Justice Manindra Mohan Shrivastava Hon'ble Smt. Justice Vimla Singh Kapoor, Order on Board by Justice Manindra Mohan Shrivastava, J. 23.07.2021 Heard on application for grant of leave to appeal. Having gone through the statement of prosecutrix (PW-5), we find that the learned trial Court in order to acquit the respondent/accused has minutely scrutinized the evidence wherein she has stated that prosecutrix did not enter into any sexual intercourse with the appellant.

Taking into consideration the aforesaid statement of the prosecutrix along with other evidence on record, learned trial Court has acquitted the appellant by giving benefit of doubt. Therefore, we do no consider present to be a fit case for grant of leave to appeal.

CRMP is accordingly dismissed.
