Upon due consideration of the submission of learned counsel for the State that the learned trial Court has not examined the evidence of the prosecutrix that her consent was obtained on false pretext of marriage and finally the accused refused to marry her which led to lodging of FIR, we are inclined to grant leave to appeal. Application for grant of leave to appeal is accordingly allowed. Let the appeal filed by the State be registered as Acquittal Appeal and be listed for further orders.
