Agrawal Order On Board 06/07/2018 (1) Learned counsel appearing for the petitioner would submit that the petitioner had filed a complaint against the respondent No. 5 - Prabhulal Sahu, who was elected Sarpanch and subsequently he was removed from the said post and his tenure has also been completed. He submits that despite the order of removal, he continued to hold the office of Sarpanch by virtue of order dated 22.10.2013, which is bad and unsustainable in law. (2) I have heard learned counsel appearing for the petitioner. (3) Since the tenure of Sarpanch has already to come to an end and almost completed, I do not find any merit in the instant writ petition.

(4) Accordingly, the writ petition fails and is hereby dismissed. However, the petitioner is at liberty to bring the notice of the competent revenue authorities for recovery proceedings against the respondent No. 5, if any.
